TERMS & CONDITIONS
The following Terms of Use are entered into by and between You (or “Client”) and The Unstoppable Mom Brain, LLC (“Company”, “we”, or “us”).
The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these “Terms of Use”), govern your access to and use of theunstoppablemombrain.com, including any content, functionality, and services related to The Unstoppable Mom Brain Retreat (“Retreat”), whether as a guest or a registered user.
By registering for the Retreat, you accept and agree to be bound by these Terms of Use and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms of Use, you must not register for or participate in the Retreat.
This Retreat is offered and available to individuals who are 18 years of age or older. By registering, you confirm that you are of legal age to form a binding contract with the Company and meet all eligibility requirements.
1. DEFINITIONS
For the purposes of these Terms and Conditions, the following definitions apply:
- Retreat – "Retreat" refers to the in-person live event organized by the Company, including any associated calls, workshops, group sessions, and activities.
- Services – "Services" refers to any direct coaching, training, or group interaction provided by the Company as part of the Retreat.
- Materials – "Materials" refers to any content, handouts, recordings, guides, or other resources provided during or in connection with the Retreat.
- Client – "Client" refers to the person registering for and participating in the Retreat.
- Company – "Company" refers to The Unstoppable Mom Brain, LLC.
2. REFUND POLICY
You have the right to cancel your Retreat registration and request a full refund within three (3) days of the purchase date for any reason.
To request a refund, you must submit a written request via email to [email protected] including the following information:
- Your full name
- Your purchase date
- Reason for the refund request (optional)
Once your refund request is received and reviewed, we will notify you of the approval or next steps regarding your refund. If approved, your refund will be processed, and a credit will be applied to your original method of payment within 7–10 business days, depending on the processing company’s policies.
No refunds will be issued after the 3-day refund window has passed.
The Company reserves the right to update this refund policy at any time. Any changes will be posted on this page, and the date of the latest revision will be indicated at the bottom.
3. CANCELLATION POLICY FOR RETREATS
No Cancellations or Refunds After 3-Day Window:
All payments for the Retreat are non-refundable after the 3-day refund window. We do not offer refunds, transfers, or credits for any reason, including but not limited to:
- Personal conflicts or scheduling issues
- Medical conditions (including COVID-19)
- Travel disruptions (including flight cancellations, border closures, or other travel restrictions)
- Government-mandated shutdowns or restrictions
- Natural disasters, acts of God, or unforeseen circumstances
- Family emergencies
- Financial difficulties
No Exceptions:
By registering for the Retreat, you acknowledge and agree that the Company will not issue any refunds, credits, or exchanges after the 3-day window, even in the event of unexpected personal or global circumstances.
Event Modifications or Cancellations by the Company:
In the event that the Company must modify, postpone, or cancel the Retreat due to circumstances beyond its control, including but not limited to natural disasters, health and safety concerns, government mandates, or travel restrictions, the Company reserves the right to reschedule the event or offer a comparable alternative. No refunds will be issued in such cases.
If the Company cancels the event without rescheduling, you will receive a full refund of the registration fee. The Company will not be responsible for any additional costs incurred, including but not limited to travel expenses, lodging, and meals.
Recommendation for Travel Insurance:
We strongly recommend that you purchase comprehensive travel insurance, including "Cancel for Any Reason" (CFAR) coverage, to protect yourself from unexpected circumstances to cover the cost of your travel and retreat fee– including personal illness, injury, family emergencies, travel disruptions, and COVID-19-related issues. It is your responsibility to arrange for travel insurance that meets your specific needs. The Company will not be held responsible for any personal losses, including travel expenses, accommodation costs, medical expenses, or other financial losses resulting from your inability to attend or participate in the event.
4. TICKET TRANSFERS
In select cases, at the sole discretion of the Company, we may allow you to transfer your registration to another individual in limited circumstances for the same event. To request a transfer, you must submit a written request via email to [email protected] with the following details:
- Your full name
- Your purchase date
- The full name and email of the person you wish to transfer your ticket to
- The reason for your transfer request
All transfer requests must be received at least 30 days before the event start date and are subject to approval at the Company’s sole discretion.
Important Transfer Terms:
- No refunds will be issued for transferred tickets.
- If you wish to be reimbursed for your ticket, this transaction must be handled privately between you and the transferee.
- The Company is not responsible for any financial arrangements, payment disputes, or agreements made between the original purchaser and the transferee.
- The transferee must agree to and comply with all event terms and conditions.
5. INTELLECTUAL PROPERTY
All Retreat content, including but not limited to recordings, materials, handouts, presentations, and guides, are the exclusive intellectual property of the Company and are protected under copyright and trademark law.
By registering for the Retreat, you agree:
- You will not reproduce, distribute, modify, or create derivative works from any of the Materials without express written consent from the Company.
- You will not share, sell, or publicly distribute any Retreat content.
- You may use the Materials solely for your personal use and internal business development.
The Company reserves the right to take legal action against anyone who violates these terms.
6. MEDIA RELEASE
By attending the Retreat, you grant the Company the irrevocable right and permission to capture, record, photograph, and/or videotape you during the event for promotional, educational, and commercial purposes. This includes the right to edit, alter, copy, exhibit, publish, distribute, and use any and all photographs, video recordings, and audio recordings in any format without payment or other consideration.
If you do not wish to be included in promotional materials, you must provide written notice to [email protected] at least 14 days before the event.
We will make every effort to honor your request; however, please note that due to the nature of group settings and the public nature of the event, we cannot guarantee that you will not appear in the background of photos or videos. If you are part of a large group photo or in the background of a general event recording, your image may still be used.
By attending the event, you understand and agree to the terms of this media release.
7. NON-DISPARAGEMENT CLAUSE
By registering for the Retreat, you agree not to make any false, misleading, or disparaging statements about the Company, the Retreat, or any related content or services, whether publicly or privately.
8. LIMITATION OF LIABILITY
The Company shall not be liable for:
- Personal injury, illness, or loss during the Retreat.
- Travel disruptions, delays, or cancellations.
- Lost or stolen property.
9. FORCE MAJEURE
The Company shall not be held liable or responsible for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to:
- Acts of God (e.g., earthquakes, floods, hurricanes)
- Fire, explosion, or power outages
- Political unrest or war
- Acts of terrorism
- Pandemics, epidemics, or other health crises (including COVID-19)
- Government orders, travel bans, or restrictions
- Strikes, labor disputes, or work stoppages
- Communication or utility failures
If a force majeure event occurs that prevents the Company from holding the Retreat as scheduled, the Company reserves the right to:
- Reschedule the Retreat for a future date.
- Modify the format, location, or content of the Retreat as necessary.
- Provide a comparable alternative.
No refunds or credits will be issued for force majeure-related cancellations or modifications unless explicitly stated by the Company.
10. GOVERNING LAW & JURISDICTION
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
Any disputes arising from or related to these Terms and Conditions or the Retreat shall be resolved exclusively in the state or federal courts located in Newark, Delaware.
By registering for the Retreat, you consent to the personal jurisdiction and venue of these courts and waive any objection to jurisdiction or venue on the grounds of inconvenience or any other reason.
In the event that any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of law, the remaining provisions will remain in full force and effect.
11. ARBITRATION
Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, the Retreat, or any relationship between you and the Company, including any dispute regarding the enforceability of this arbitration provision, shall be resolved exclusively through binding arbitration conducted in Newark, Delaware in accordance with the rules of the American Arbitration Association (AAA).
You hereby expressly waive any and all claims you may have, now or in the future, arising out of or relating to this Website, the Company, any and all contracts you enter into with the Company, and any and all of the Company’s products and services.
To the extent that you attempt to assert any such claim, you hereby expressly agree to present such claim only through binding arbitration to occur in Newark, Delaware. You further agree to and do hereby waive any right to class arbitration and agree, instead, to conduct an arbitration related solely to any individual claims you and/or any entity related to you asserts against the Company.
The arbitration shall be conducted by a single arbitrator appointed in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding, and judgment upon the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
The prevailing party in any arbitration or legal proceeding arising out of these Terms and Conditions shall be entitled to recover its reasonable attorneys' fees and costs from the other party.
Responsibility for Costs:
To the fullest extent permissible by law, you agree that you shall be responsible for all costs associated with initiating the arbitration and for the administration of the arbitration, unless the arbitration rules state otherwise.
12. ENTIRE AGREEMENT
These Terms and Conditions, together with our Privacy Policy and any written agreements you enter into with the Company, constitute the entire agreement between you and the Company regarding your participation in the Retreat.
Any failure by the Company to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
These Terms and Conditions supersede all prior and contemporaneous agreements, representations, and understandings, whether oral or written, relating to the subject matter contained herein.
13. CHANGES TO TERMS AND CONDITIONS
The Company reserves the right to update or modify these Terms and Conditions at any time in its sole discretion.
If significant changes are made, we will provide notice through email or by posting an updated version of the Terms and Conditions on our website. Changes will be effective immediately upon posting unless stated otherwise.
